1. Acceptance of Terms By accessing and using the Scapefy website and services, you accept and agree to be bound by the terms and provision of this agreement.

2. Intellectual Property & Usage Rights

Client Materials: You retain ownership of all architectural plans, CAD files, and design concepts you submit to us. You grant Scapefy a non-exclusive license to use these materials solely for the purpose of creating the requested visualizations.
Scapefy Deliverables: Upon full payment, Scapefy grants the Client a perpetual, non-exclusive, worldwide license to use the final renderings and animations for marketing, sales, and presentation purposes.
Portfolio Rights: Unless a Non-Disclosure Agreement (NDA) is signed, Scapefy reserves the right to display the final renderings in our portfolio, website, and social media channels for self-promotion purposes.

3. Accuracy of Information Scapefy creates visualizations based on the information provided by the Client. We are not architects of record or engineers. Our renderings are for conceptual and artistic representation only and should not be used for construction purposes without verification by a licensed professional. We are not liable for construction errors resulting from the use of our visualizations.

4. Limitation of Liability In no event shall Scapefy, nor its directors, employees, partners (including Studio Pech), agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.

5. Governing Law These Terms shall be governed and construed in accordance with the laws of North Carolina, United States, without regard to its conflict of law provisions.

6. Changes to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time.

7. DATA RETENTION & STORAGE POLICY

7.1. Storage Period: Scapefy is not a cloud storage or backup service. While we may retain project files (including source photos, CAD plans, and 3D models) for a period of up to six (6) months following project completion to facilitate potential revisions, we have no obligation to retain these files indefinitely.
7.2. Data Deletion: We reserve the right to delete client source files and project data from our servers 90 days after the final delivery of the project without prior notice to free up storage space and ensure data security.
7.3. Client Responsibility: It is the sole responsibility of the Client to maintain their own backup copies of all materials submitted to Scapefy and all final deliverables received. Scapefy shall not be liable for any loss, corruption, or inability to restore data once the project is completed.
